Defendant was charged, in an indictment returned by the Grand Jury of Polk County, and filed October 2, 1956, with the Crime of Operating a Motor Vehicle while Intoxicated (Third Offense) as defined in Section 321.281 of the 1954 Code of Iowa, I.C.A., upon the public highway of Polk County, Iowa, on or about July 13, 1956.
