Plaintiff's action is for the recovery of total and permanent disability benefits under the provisions of the Workmen's Compensation Act and likewise seeks to assess the defendant, New Amsterdam Casualty Company, the workmen's compensation insurer of plaintiff's employer, Leon Bigner, with statutory penalties as provided in LSA-R.S. 22:658.
