This is an appeal on questions of law from a judgment rendered by the Municipal Court of Akron, Ohio. The trial court sustained a demurrer to a reply, and thereafter, upon the refusal of Elza Metz, the plaintiff herein, to amend his pleading, the court dismissed the action. He then appealed.
