This is a suit in trespass to try title. The parties stipulated on the common source of title. The jury found substantially that (1) in the year 1934 the representatives of the Underwriters at Lloyds America did not make demand upon Darwin for the payment of the $1,500 note; (2) in the year 1938 the representatives of Underwriters at Lloyds America did not make demand upon Darwin for the payment of the $1,500 note.
