In this case the plaintiff, a sewer contractor, brought suit against the defendant city for damages claimed to have been caused by the excessive cost of constructing a sewer for the city, on account of the city's having misrepresented the character of subsoil conditions, known to the defendant city, namely, quicksand and excessive water.
