SPALDING, J.

The plaintiff, a police officer of the city of Everett, brings this bill for declaratory relief to determine whether he is eligible for retirement and a pension under the provisions of G.L. (Ter. Ed.) c. 32, § 83A (a), inserted by St. 1946, c. 576, § 3.

The pertinent facts, which are not in dispute, are these. The plaintiff successfully passed a mental and physical examination given by the civil service commission on January 18, 1927...
