The plaintiffs, who are real estate brokers, sued the defendants, who are also real estate brokers, on an alleged agreement to divide commissions. The trial judge, sitting with a jury, granted the defendants' motion for dismissal at the close of the plaintiffs' case. An appeal was taken to the Appellate Division from the ensuing judgment and we certified it on our own motion...
