This is a motion to dismiss the defendants' affirmative defense on the ground that it is insufficient in law; and secondly, to dismiss the counterclaim on the ground of (a) insufficiency; (b) that it was not interposed by the real party in interest; (c) that the court has no jurisdiction over the subject matter.
