This is an appeal from a conviction on a charge of assault with intent to commit rape.

The defendants Nelson, Lewis and Fells were charged in Count I with forcible rape upon one Guadalupe Velesquez, and in Count II with assault with intent to commit rape upon Maria Velesquez. Nelson was also charged with two prior convictions. He admitted the priors, and all three defendants pleaded not guilty to both counts. A jury found Nelson and Lewis guilty...
