This is an appeal on questions of law from a judgment of the Common Pleas Court of Franklin County entered on a general verdict returned in favor of the defendant in an action to recover for wrongful death.
In her petition plaintiff alleges that on April 6, 1952, at approximately 1:30 a. m., the decedent was walking from west to east on the north side of Whittier Street in the city of Columbus
