In his complaint plaintiff alleged that defendant was an employee, but on the trial he contended that the relationship between the parties was fiduciary and confidential with respect to the sale of a product known as "Soldax". The Official Referee found that defendant was merely a buyer and plaintiff a seller, and that no relation of trust and confidence existed between the parties.
