OLIVER, Justice.

Defendant was a farmer. His family consisted of his children, Letha aged fifteen years and Layton, aged eleven years. He was tried, convicted and sentenced for the crime of incest with Letha. He has appealed to this court.

There was evidence defendant had sexual intercourse with Letha approximately one hundred times during the two year period prior to and including July 21, 1952, the date of the alleged act for which defendant was tried. Letha...
