The petitioner excepts to an order of the single justice entered December 29, 1953, refusing to issue a writ of error looking to the reversal of a sentence to the State prison imposed upon the petitioner in the Superior Court on October 24, 1951, for the crime of unlawfully using an instrument on the body of a woman named Pitts for the purpose of procuring her miscarriage.
