This is an action for damages arising from an automobile accident resulting in the death of plaintiff's intestate. Issues were made and trial had. Defendant requested an instructed verdict which was denied. The jury returned a verdict for plaintiff. Defendant moved for judgment notwithstanding the verdict. The motion was denied. Plaintiff moved for a new trial. It was granted. Defendant appeals assigning error as to both rulings. We sustain...
