This is a suit filed under the provisions of R.S. § 4915 as amended, 35 U.S.C.A. § 63. Since its filing Section 63 has been repealed and recodified by Sections 145 and 146 of Title 35. The plaintiff seeks to reverse a decision of the Board of Interference Examiners of the Patent Office which awarded priority to Defendants Paden and Mackay, and the consequent refusal of that tribunal to grant plaintiffs a patent.
