The defendant, Joseph Agostino, was convicted and sentenced on a charge of occupying premises with books, apparatus or paraphernalia for the purpose of pool selling, in violation of the Act of June 24, 1939, P.L. 872, 18 PS 4607. On November 7, 1952, at about 4:40 P.M., state, county and city police officers conducted a raid on 638 Harris Street, Harrisburg, Pennsylvania.
