CANDLER, Justice.
1. The motion for new trial in this case is based on the same evidence and the same charge of the court as in Fincher v. State, ante; and, with the exception of a special ground which will be dealt with in the next division of this opinion, it contains grounds identical with those urged in Fincher's case. Hence the rulings there made are controlling in this case.
