In an action commenced under Public Law 414, ch. 477, 66 Stat. 1631 against the Secretary of State and others for a declaration that plaintiff is a citizen of the United States and for other relief, defendants move for an order dismissing the action on the grounds (1) the court lacks jurisdiction over the subject matter and (2) plaintiff has failed to state a claim upon which relief can be granted.
