This is an action brought by the administrator of the estate of Ila M. Stewart, deceased, to recover the sum of $2,881.29, representing a portion of a deficiency assessment of federal estate tax and interest paid by that estate during 1942. Payment of the taxes under protest, timely claim for refund and denial thereof, are admitted.
