Appellant was charged by affidavit under Acts 1941, ch. 148, § 9, p. 447, being § 10-3001, Burns' 1942 Replacement, with the crime of grand larceny, tried by the court without the intervention of a jury, found guilty as charged and sentenced to the Indiana State Prison for a period of not less than one year, nor more than ten years, fined in the sum of $100, and disfranchised for a period of five years.
