On September 6, 1950, defendant Amor was the owner and operator of a restaurant in the city of Los Angeles. Plaintiff was a paving contractor. On that day plaintiff was preparing to pave and surface a driveway and certain portions of defendant's property to the rear of the restaurant. A wooden post obstructed the driveway.
