Order modified on the law by adding at the end of the ordering paragraph "without prejudice to an action under section 51 of the General Municipal Law or to any right petitioner may have to appear in a proceeding to condemn the property and to oppose therein the vesting of title." As so modified the order is unanimously affirmed, without costs.
