We will herein refer to parties to this action as they appeared in the trial court where plaintiff in error was defendant and defendant in error was plaintiff. The trial court directed a verdict for plaintiff on his first claim which was for certain cattle purchased by defendant from plaintiff, and the jury returned a verdict for plaintiff on his second claim for exemplary damages in the sum of $5,000.
