This personal injury action was heard by the trial court without a jury. At the close of plaintiff's case, upon motion of the defendant, the court dismissed the lawsuit, holding that it was barred by certain provisions of the workmen's compensation act, and that plaintiff was contributorily negligent and had assumed the risks of his employment.
