The original petition was filed July 3, 1941. The regular judge was disqualified and Honorable K. W. Blomeyer was named as special judge of the Stoddard County Circuit Court. The case has been in this Court before. On February 7, 1951, McDowell, Judge, of this Court, wrote an opinion, concurred in by Vandeventer, Presiding Judge of this Court, and by the writer.
