The plaintiffs below, appearing here as appellants, complain of a judgment against them in the sum of $3,500 rendered in a replevin action in which defendants elected by their answer to take the value of the property recovered under the writ of replevin in the event the plaintiffs should fail to prosecute their suit with effect and without delay, as provided in 1941 Comp. § 25-1512. The parties will be referred to in this court as they were designated...
