Defendant is the owner of the tracks at the crossing in Bettendorf, Iowa, where the collision occurred between a Ruan Transport Corporation truck, driven by plaintiff, and a train of the Chicago, Burlington & Quincy Railroad Co., hereinafter for convenience, called the CB&Q.
