This is the second time that defendant has been convicted of the first degree murder of Joe Lopez and sentenced to pay the death penalty. State v. Trujillo, 117 Utah. 237, 214 P.2d 626. The defects in the instructions which were the ground for granting the new trial on the first appeal were corrected in the second trial but defendant again asks us to reverse his conviction...
