This is a motion filed under the provisions of Section 2255 of Title 28 U.S.C.A. to vacate judgment and sentence in criminal case No. 9620. An answer to said motion was filed by the respondent and a reply was filed by the Petitioner. Petitioner was tried and convicted in this Court in December, 1939, of having violated Title 12 U.S.C.A. § 588b, sub-sec. (a), now Title 18 U.S.C.A., Section 2113(a). Petitioner was found guilty on both counts...
