The appellants herein, Mr. and Mrs. Emil Denemark, are residents of Chicago, and are partners owning a string of horses and operating a racing stable.

In the fall of 1948 they decided to build a stable near the race-track at Hot Springs, Arkansas, and had plans and specifications prepared by an architect in Chicago.
