PORTERIE, District Judge.

On August 14, 1948, plaintiff, a citizen of Louisiana, filed this action against defendant, a Louisiana corporation, under the Federal Employers' Liability Act, 45 U. S.C.A. § 51 et seq., claiming damages in the sum of $40,000.00.

The complaint alleges plaintiff to have been employed as a brakeman with defendant and that while making a "flying switch" he was injured, which injury later manifested itself to be a fractured elbow...
