Defendant, Joseph A. DeCarlo, was charged in Police Court with two certain crimes, namely, leaving the scene of an accident, in violation of subdivision 5-a of section 70 of the Vehicle and Traffic Law, and also with the crime of driving a motor vehicle while in an intoxicated condition, in violation of subdivision 5 of section 70 of the Vehicle and Traffic Law of the State of New York.
