This case comes before the Court on defendant's motion for a change of venue under Section 1404, Title 28 U.S.C.A.

The motion presents a somewhat close question under the new section of the Code which permits the Court to grant a change of venue in the interest of justice and for the convenience of the parties and witnesses. It is conceded that this action could have been lodged in the Northwestern Division of the District of North Dakota...
