The defendant below, Troy Williams, was charged, tried and convicted by a jury in the superior court of Okmulgee county, Oklahoma, of the crime of first degree manslaughter.

In the information it was alleged in substance that on the night of December 26, 1947, defendant, at a point approximately two miles north of Beggs, Oklahoma, while under the influence of intoxicating liquor and driving a Chevrolet truck, feloniously drove the same into the body...
