The appellants herein are known as the Gilbert heirs and the appellees are known as the Lobley heirs.

On December 31, 1945, the district court of Montague County entered judgment in this suit, which was instituted by Grady Chupp et al., owners of one-half the minerals under the F. J. Bellows Survey, located in said County, against the heirs of William Fanning et al., to have the other half of said mineral estate placed in the hands of a receiver...
