CARR, J.
Defendant was convicted of first-degree murder by a jury in the circuit court of Oakland county. The information against him charged that on, to-wit, the 10th of May, 1947, at the township of Orion in said county, the defendant "feloniously, wilfully and of his malice aforethought, did kill and murder one Richard Edward Schweitzer." Following the conviction, sentence was imposed in accordance with the statute.
