The defendant, Thomas J. O'Malley, Jr., was indicted in the circuit court of Stephenson County for the crime of embezzlement. The indictment contained eight counts, the first six charging defendant with the crime of embezzlement by an agent and the last two charging embezzlement by an attorney, a misdemeanor.
