The petitioner (in personam) moves this court for an order vacating and setting aside a judgment of conviction rendered against him on the 17th of January, 1935, upon constitutional and statutory grounds. The judgment of sentence he attempts to attack is the result of a jury verdict finding him guilty of the crime of assault in the first degree.

This petitioner and another were indicted by the Grand Jury of this county for the crime...
