This is an appeal from a judgment and conviction of appellant for first degree murder followed by a death sentence.

The testimony of all the witnesses, including appellant, was that a number of persons, among whom were included appellant, and the deceased, one Lee Hunter, had gathered in the apartment of one Lurline Bost at 1718 8th Street, Northwest, Washington, D.
