Equity Rule 75 (28 USCA § 723) prescribes the procedure for drawing onto the record a condensed statement of the trial proceedings. It contemplates one statement, and one only. If counsel cannot agree upon a fair condensation of the evidence, the trial court is empowered to direct a proper statement. This rule has been flagrantly violated here.
