On August 9, 1934, the bankrupt filed herein a debtor's petition under section 75 of the Bankruptcy Act (11 USCA § 203) asking opportunity to endeavor to effect a composition or extension agreement with his creditors. The conciliation commissioner to whom the petition was referred reported in due course that it was impossible to effectuate such an agreement.
