This was an action by the appellant against the appellee, the surety on a bond given by C. H. Van Ormer, the contractor for the construction of a hotel building at Dothan, Ala. The complaint set out a copy of the bond and a copy of the contract, a copy of which by reference in the bond was made a part thereof.
