The plaintiff brought this action to quiet title to 160 acres of land located in Osage county, Okl. The land was allotted to Umpah-to-kah, a member of the Osage Tribe of Indians. There is no controversy as to the facts, and they may be briefly summarized as follows:

Um-pah-to-kah, the allottee, died intestate in July, 1910, a minor, without issue, and left surviving as her sole and only heirs at law her father, George Bigheart, and...
