This case is controlled by the decision in McCluskey v. Marysville & Northern Railway Company, just decided, ante, 36. As in that case, the suit was brought under the Federal Employers' Liability Act to recover damages for injuries suffered while Bay, the plaintiff in error, was employed by the defendant on its logging railroad.
