Mason Campbell, upon a brief submitted by himself and Mr. Black, (Attorney General,) for the United States, and submitted on printed arguments by Mr. Smith for the defendants in error, and by Mr. Stanberry, who intervened as representing the late collector at Cincinnati, whose case was identical with that of the collector at Mobile.

Mr. Justice CLIFFORD delivered the opinion of the court.

This case comes before the court upon a writ of error to the Circuit Court of the United States for the southern district of Alabama. It was an action of debt brought by the United States upon the official bond of the defendant as collector of the customs for the district and inspector of the revenue for the port of Mobile.
