Mr. Chief Justice MARSHALL delivered the opinion of the Court, and after stating the facts, proceeded as follows:

In opposition to the claim of the plaintiffs, it is alleged by the defendants, that the debt of Bayley has been discharged. As they have not succeeded in supporting this allegation, it will be necessary to inquire whether, in such a case as this, the plaintiffs can assert a lien on the land sold by Bayley to Greenleaf...
