MARSHALL, Ch. J. delivered the opinion of the Court as follows:

Much of the seeming intricacy of this cause will disappear, if we extricate the questions made by the pleadings before the Court, from others which might greatly embarrass and perplex it.

The declaration contains four counts. The first recites an original contract between Cleon Moore and John Darby, for the sale of certain lands, lying in Kentucky, and proceeds to recount in detail those transactions...
